Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Brecx platform and services (the "Service"), operated by Fresh and Finest ("Fresh and Finest", "Brecx", "we", "us"). By using the Service, you agree to these Terms. Please read them carefully, and contact us at the address below if anything is unclear.

Using the Service

You may use the Service only in compliance with these Terms and all applicable laws, and only with marketplace accounts you are authorized to manage. You are responsible for activity under your account and for keeping your credentials secure.

Acceptable use

You and Brecx will use marketplace data only to operate your account and provide the Service. In particular, you agree not to use the Service to:

• Use marketplace data or buyer personal information (PII) for any purpose other than operating the relevant seller account — buyer PII may be used only to fulfill and operate orders.
• Sell, rent, share, license or otherwise transfer marketplace data or buyer PII to any third party.
• Use buyer PII to market or advertise to buyers, or to contact buyers except as required to fulfill an order.
• Combine marketplace data with other data, or use it for analytics or competitive purposes, in any way the marketplace prohibits.
• Violate any marketplace's terms, policies, or data-protection requirements.
• Access, collect or use data you are not authorized to access.
• Reverse engineer, disrupt, or attempt to gain unauthorized access to the Service.
• Misrepresent pricing, listings, or seller information in any channel.
• Use the Service for any unlawful, deceptive, or harmful purpose.

You agree to comply with each connected marketplace's developer and data-handling policies, including those of Amazon, Walmart, eBay, TikTok Shop and other connected marketplaces.

Marketplace connections

When you connect a channel, you authorize Brecx to access and act on the relevant marketplace data on your behalf, limited to the least-privilege scopes needed for the features you enable. You can revoke this access at any time by disconnecting the channel, after which associated marketplace data is deleted as described in our Privacy Policy.

Data protection

We protect the data we process in line with the safeguards and retention rules set out in our Privacy Policy, including encryption in transit and at rest, least-privilege access, incident response, and deletion of buyer PII within 30 days of order delivery — consistent with each connected marketplace's data protection requirements.

Availability and changes

We work to keep the Service available but do not guarantee uninterrupted access. We may update, suspend, or discontinue features, and we may revise these Terms; material changes will be communicated through the Service or by email.

Limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, and Fresh and Finest is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

Governing law

These Terms are governed by the laws of the jurisdiction in which Fresh and Finest is established, without regard to its conflict-of-laws rules.
